The Sierra Club and Environmental Integrity Project plans to sue Alcoa Warrick.
The groups accuse Alcoa of repeatedly violating the Clean Water Act, including dumping illegal amounts of mercury, into the Ohio River.
The groups claim there have been at least 101 violations since 2018.
Alcoa claims the company is operating under legal requirements and that it consistently transparently works with regulatory authorities.
Alcoa could face penalties of nearly $65,000 per day for each violation.
