A lawsuit has been filed against Tropicana Evansville/Aztar Indiana Gaming Company LLC by employees alleging the company violated the Indiana Wage Payment Statute.
Attorney Alex Ricke says in Indiana, workers who make a certain amount in tips can be paid below minimum wage as long as the lost wages are made up by tips.
It’s only legal if the employer provides a tip credit notice which the lawsuit claims the casino did not.
Workers hired after 2018 are already part of the lawsuit.
Those wanting to opt out have until October 31.
