A judge in Lauderdale County has granted the State of Alabama’s motion to drop a charge of escape against Casey White.
Prosecutors will instead take the case to a grand jury to get a formal escape charge against white, who fled the jail with former corrections officer Vicky white.
They were captured in Evansville after Vicky White shot herself to death.
Prosecutors say the evidence is so overwhelming that a preliminary hearing isn’t needed.
The Defense objected, saying evidence that would come out at a preliminary hearing would help White’s escape case, and his capital murder trial later.
