Last month a mistrial was announced for 22 year old Robert Garner of Owensboro, because of possible jury tampering.
A new trial date is scheduled for August 15.
Garner was charged with the murder of 21 year old Cody Glover.
Garner, who was 18 at the time, was under the influence when his vehicle left the road and overturned in a lake on U.S. 60 East in 2017.
Glover was his passenger and died from drowning.
They were last seen at a party in Breckinridge County before the crash.
