An Evansville family suing Walgreens has requested the case be moved back down to the superior court.
The motion was filed last week by the family’s attorney.
The case moved to the district court at the request of lawyers for Walgreens.
They then requested the case be heard by the Supreme Court.
In October 2021, four members of the Price family went to the North St Joseph Avenue location for flu shots.
They learned they were given COVID-19 shots instead.
The parents allege their children developed heart issues.
The lawsuit stems from damage resulting from the mix-up.
