The parents of eight year old Marco Gabriel have filed a complaint with the U.S. District Court in Evansville.
Marco was taken to St. Vincent Urgent Care last September to be seen by a doctor.
Then told to take him to the emergency room for an MRI.
His parents say, no testing was done and was sent home with life-threatening conditions.
Marco was returned two days later to the ER.
Attorney’s say test results showed he had acute multifocal encephalitis.
He was flown to a Louisville hospital and declared brain dead on September 22.
The Gabriel’s claim St. Vincent treated them different because of their Peruvian Citizenship and being uninsured.
